Description:
Brief description of the tender: The service concession is granted by the concession contract concluded as a result of the tender, the object of which is the provision of the service of proving the conformity of the precious metal sample to the standard sample. The fee of the precious metal sample verifier (concessionaire) consists of the right granted to the concessionaire to provide the specified service and to receive payment from the users of this service for providing the service. The business risk related to the demand for the service is transferred to the concessionaire. Pursuant to § 40 (1) of the Precious Metal Products Act, the verifier of a precious metal sample is a company that performs verification of the conformity of the precious metal sample to the standard sample. The mentioned company is an entrepreneur with exclusive rights within the meaning of the Competition Act. According to the Precious Metal Products Act and the Competition Act, the successful tenderer will be granted the exclusive right to act as a precious metal sample verifier on the territory of the Republic of Estonia.
